Court upholds 6-year prison for two brothers over attempted murder of man

AMMAN — The Court of Cassation upheld a February 2022 Criminal Court ruling, sentencing two brothers each to six years in prison after convicting them of attempting to murder a man in Irbid in May 2020.

The Criminal Court declared the defendants guilty of attempted murder, stemming from “a heated dispute” with the victim on May 3, 2020.

The court acquitted a third defendant who was standing trial for charges of complicity in attempted murder for a lack of evidence.

The defendants were given the maximum sentence.

Court papers said one of the defendants engaged in a heated argument with the victim one day before the incident.

The defendants called the victim and asked him to meet the following day to discuss the matter, according to court papers.

In the meantime, the two siblings prepared “the blunt objects they planned to use when they met the victim”.

When the three met, the court maintained, “the two brothers drew an iron bar and a wooden stick and beat up the victim on his head and different parts of his body”.

"The two defendants then fled from the area and were later arrested by police," court documents said.

The victim was rushed to a nearby hospital and survived the assault after undergoing surgery to his skull, the court papers added.

The defendants contested this ruling via their lawyer arguing that there were “legal errors in the investigation procedures”.

The Criminal Court’s attorney general asked the higher court to uphold the six-year sentence ruling against the two defendants.

The higher court ruled that the Criminal Court proceedings were accurate and that the defendants were given the appropriate punishment.

The Cassation Court bench comprised judges Mahmoud Ebtoush, Nayef Samarat, Hammad Ghzawi, Qassem Dughmi and Mohammad Khashashneh.
